E-cigarettes Shall Be Subject To The Relevant Regulations On Cigarettes

The decision shall come into force on the date of its promulgation.

The Regulations of the People’s Republic of China on the Implementation of the Law on Tobacco Monopoly shall be revised accordingly and re-promulgated.

Chapter I General Provisions

Article 1 These Regulations are formulated in accordance with the Law of the People’s Republic of China on Tobacco Monopoly (hereinafter referred to as the Law on Tobacco Monopoly).

Article 2 Tobacco monopoly refers to the system whereby the State exercises monopoly and unified control over the production, sale and import and export of tobacco monopoly commodities.

Article 3 The term “cut tobacco” as used in tobacco monopoly commodities refers to the silk, finished or granular commodities processed from leaf tobacco, recured leaf tobacco and thin tobacco slices.

Article 4 The functions and leadership system of the department of tobacco monopoly administration under The State Council and of the departments of tobacco monopoly administration of the provinces, autonomous regions and municipalities directly under the Central Government shall be governed by the provisions of Article 4 of the Tobacco Monopoly Law. Where a city or county has a department of tobacco monopoly administration, the department of tobacco monopoly administration at the city or county level shall be in charge of the tobacco monopoly work within its own administrative region and shall be under the dual leadership of the department of tobacco monopoly administration at the next higher level and the people’s government at the same level, with the leadership of the department at the next higher level being the main one.

Article 5 The State exercises control over the tar content of cigarettes and cigars and the main additives used in cigarettes and cigars.
